Hi all. Just had the craziest call to Virgin holidays paying for our trip to orlando this may, we have 2 boys under 12 traveling with us, we have treated the family by sitting in PE but because of this we don't get a refund, only in economy they said, it's called (premium economy) seems we're being punished for giving Virgin more money, which was a £3k upgrade return

I understand your frustration but PE is still a Premium cabin (literally :P) and thus eligible for APD for U12s. Unfortunately, this is one to be angry at the government for and VS are simply obeying the law.

Feel free to hit out on them about their fuel and insurance surcharges (YQ) though ):

VS are 100% correct and they are simply following the law which is that the APD exemption for U12s is in economy only.

Premium Economy is not the same as Economy.

In fact the legislation and regulations don't mention cabin class names at all only 'Standard' and 'Reduced' rate.

APD goes to the Treasury. VS is merely acting as collector - just like shops collect VAT on behalf of the Government.

APD is only waived for the lowest available travelling class on each flight (usually Economy).

I guess this means you don't pay it on business class only BA flight 001 (LCY-JFK)

The BA01 & O3 flights do attract APD because they exceed the seat pitch (40") that otherwise would exempt them for being a single class aircraft.
