Just had a reply to the e-mail I sent them asking for a breakdown of my claim and flight sectors.

Mr Mannion,

The Court-approved Settlement Agreement provides for a refund of 33.3% of the passenger fuel surcharge you paid on qualifying coupons. Based on the information provided on your claim form, you have 6 qualifying coupon(s). A detailed accounting of how your refund was calculated is attached.

Not bad seen as I had 18 qualifying flights - looks like I'll have to go back and list all my flights in that time instead of relying on my FC number.

Class of travel is irrelevant, but the date of purchase is - to give an idea per sector:

Date of Purchase Refund Amount
08/11/2005 14.55
12/13/2004 6.71
01/29/2005 6.71
04/04/2005 10.87
11/23/2005 16.77
12/22/2005 16.77

Well, I finally got a reply from them:

You provided information for 2 flights. Using this information, we found 1 qualifying coupons. There are many reasons why some of the flight information you provided may not match to a qualifying coupon. Please read the Notice to Claimants (available at http://www.airpassengerrefund.com/Documents.aspx) for a full description of
qualifying coupons. Please note that the information used to identify your qualifying coupons was taken directly from Section B of your claim form. If you feel that there may have been typos or missing information, you may submit additional information by mail only.

Sure enough, there's only 1 flight listed on the attachment. Given that I only provided FF numbers for VS & BA, it looks like simply providing your FF number wasn't a good idea after all....[V][ii]

As Mcuth outlined above - BEWARE - if you thought you were covered by claiming via your Flying club number - you are not!!!!

I had four passengers flying LHR to LAX return, equivalent to eight vouchers. (One voucher for each leg of the journey). I received payment for one voucher. This despite their assurance that:-
*NOTE: If you choose this option and provide only your British Airways Executive Club Number or Virgin Atlantic Flying Club Number, you need not provide any additional information to receive a refund for flights booked using that number. However, if you booked flights where you did not submit your British Airways Executive Club Number or Virgin Atlantic Flying Club Number, and want to obtain a refund for those flights, you MUST complete Option 1 above.

The only way you can claim for the missing additional vouchers is via snail mail and provide them with all the information -Airline - First Name - Surname - Date of Departure - Origin - Destination - Flight number - FOR EACH LEG.

My concern is how many people have received their 'free money' and not realised that they have been underpaid.

Does this mean we have confirmation that the outfit handling this service have underpaid people ? Where's the lawyers with their class action suit against the lawyers.....

Seems like they're quite busy with email questions at the moment - chasing a reply to my email of 28th June, I got:

quote:Thank you for your inquiry. Due to a high volume of requests, individual responses are taking several business days. Your message has been received and a staff member will reply.

Wonder how many people are querying their flights....

Well, got a reply - seems like they must've had some complaints about those submitting FF numbers only...

quote:Mr {mcuth},

The Court-approved Settlement Agreement provides for a refund of 33.3% of the passenger fuel surcharge you paid on qualifying coupons, not the class in which you flew. Each qualifying coupon represents one round-trip ticket.

There are many reasons why some of the Frequent Flyer Numbers you provided may not match to a qualifying coupon. Please read the Notice to Claimants (available at http://www.airpassengerrefund.com/Documents.aspx) for a full description of qualifying coupons. Please note that the information used to identify your qualifying coupons was taken directly from Section B of your claim forms. If you feel that there may have been typos or missing information, you may submit additional information by mail only:

Air Passenger Fuel Surcharge Settlement
Kenneth R. Feinberg, Distribution Agent
c/o Epiq Systems
PO Box 62677
ondon EC2P 2UB
England

Due to the large number of airline records involved in the settlement, some claims require additional research to confirm the eligibility. All Frequent Flyer Numbers that were submitted on your claim forms are being reviewed. If it is determined that a flight is eligible for a refund under the Settlement terms, then you will receive payment in one of the future cheque mailings. If additional information is needed or if a flight is found to be ineligible, you will receive notification of the results and instructions on what options are available.

Kind regards,

I don't think I can be bothered chasing this up. I was vastly underpaid on VS flights but vastly overpaid on the BA ones.

Which will now cost you more anyway, as fuel duty has increased today [:w]

Mr DL eventually got his today (79.13). I'm still awaiting mine [:(!]. I submitted my FC number - he submitted each flight detail (both completed and sent on-line at the same time). Anyone else still awaiting their initial payment or am I the only one?

Have managed to get 1 extra ticket added on so far, and they're reviewing another one. Had one excluded as my old work paid for the ticket, which I'd forgotten.

The one they're currently reviewing has a ticket issue date of 11th August 2004 - the 1st day of the surcharge claim period. They're saying it was purchased on 4th August and doesn't count (can't honestly remember when it was actually bought as I only have the e-ticket now) - however I think it should be on the ticket issue date, since that's when the ticket is really purchased isn't it?

I chased my missing payments the week before Christmas, got through to someone in the US, and while polite, they were completely unhelpful.

Well, I've got my reply from them on this issue:

quote:Mr. {mcuth},

I apologise for the confusion. The e-ticket that you provided on 29/9/09 does show that the ticket was issued on 11/8/2004, but it does not show the date of purchase. According to the Settlement Agreements, it is the date of purchase, and not the date of issue or date of departure, that qualifies a ticket as eligible for a partial refund of the fuel surcharge.

If you have documentation, such as a credit card statement, that shows that the ticket was purchased/paid for on 11/8/2004 or thereafter, we will be able to perform additional research. Otherwise, this ticket is not eligible for refund.

Please do not hesitate to contact us should you have any further questions.

Kind regards,

Amanda M.

Convenient that it's down to me to prove when a ticket from 6 years ago was purchased, but the e-ticket itself doesn't suffice? Am tempted to keep on with this just for the pure PITA value...

Well at long last, my cheque arrived for 24 (and a few pence). Mr DL received 79.13 ages ago (same journeys).Crackers. Emailed them and the reply was much the same as mcuth's above about one of the flights (which I know was ticketed in the time span but haqve no way of now proving it).
Still a difference of over 50.

I, too, have finally received a ..... reply. Apparently I did not give them enough information [n]. I checked the spreadsheet I sent, which was their template, and it clearly states name and e-ticket numbers is enough. I filled in a bit more information (Flight, Destination, flight date - surely derivable from the e-ticket number[:?]) and sent it off. They replied, saying they have now located 'qualifying ticket matches based on the information you provided' and I should expect payment in another 6 to 8 weeks. Jeez [:(!]

I have sent copies of my missing tickets, and have been told a second time that 'Payments will be made periodically until the 31st Dec 2012 to people who have made a valid claim'

Despite their inadequacy in processing my application, from Sep 2008, this is the best information I can get out of them.

Does anyone else have the same problem ?
Who can I complain to ? As it appears they have 77M quid and they are holding onto as much of it as they can for as long as they can.

Who regulates these people ?

Bizzarely I had another letter about a week ago (a month after my complaining email to them) saying that my payment was being processed (same as the original letter I received)[:?]. Lets see if I get the extra 50+ quid that Mr DL received for the same flights taken as me? TBH I think they're just making up settlement figures willy nilly.
