NYLON wrote:Hello!

I'll keep out of the ethics on this one, only to muddy the waters by putting in another ethical & legal query.

(Just to be clear, I'm not suggesting/condoning/"hating-on" this idea as a reality, I'm just curious in the hypothetical)

Would it a) be legal, and if so b) ethical for an UC-flyer or AU member to sell clubhouse access to rosiej83 (assuming everyone on the same flight etc)?

Hello... |:)

Hypothetically:
a) no... it verges on fraud and probably criminal trespass. I'm also fairly certain it contravenes clause 9 of the VS FC T&Cs regarding the bartering, selling and auctioning of programme rewards... At the very least VS could revoke miles/status/the option to fly on their planes, before deciding whether or not to pursue any legal recourse ii)

b) Slightly more interpretive, but I would say no.. It is a privilege not a right, and as such would be considered theft in my eyes. I always did root for Javert to catch Valjean...

Nothing wrong with a good hypothetical quandary NYLON, there is no need to duck for cover. 8D

With respect Joey, I doubt that fraud or criminal trespass apply. And although the FC T&Cs might apply they cannot be imposed on the non FC purchaser of a UC ticket.

Of course, it might not be within the spirit of such things to take money in return for admission but I am not convinced that inviting strangers into the clubhouse is within the spirit of such things either.

Not meaning to sound confrontational, but I think you'll find they could.... Fraud for selling/bartering lounge access, where it is not your place/authority to do so, and as such also defrauding VS in terms of either food/beverage/treatments etc consumed or straight up money ordinarily demanded in exchange for access (i.e theft)

Criminal trespass in that the "guest" has illegitimately obtained entry and as such is trespassing on property in the hands of VS (whether leased or owned). Imagine giving your house keys to your neighbour for emergencies and subsequently your neighbour charges complete strangers an access fee for unsupervised access to your house without your knowledge or compliance...

I'm sure we could make a case either way :P

A very interesting thought..... I am fairly certain I read something in the conditions of carriage once upon a time regarding the transfer of inclusions in tickets being not allowed to other ticket holders. Hypothetically, this would include the transfer of a guest pass for the lounge to other flyers not directly travelling with you .... I'll give it a look a bit later so I can be a touch more accurate.

At the very least VS could refuse carriage, which should be more than enough not to risk it.

I think it depends on the circumstances.

If it's a complete stranger and you've arranged to meet at CH for access, I think charging for CH access goes against the spirit of what is intended.

But, if it's a friend, then something could change hands. You pay for the taxi to the airport, I get you into the C/H. All very informal and perfectly fine! Although I wouldn't be so mean spirited!

In years to come, this will be one of those threads long-standing members will hint at nostalgically...

The OP has bowed out, it would seem, and that is a shame as it was good sport!

Apparently we're a bunch of haters so that's probably why she bowed out ):
It's a pity though.

Hope all is ok now Karen, sides literally splitting? :o)

Will post if I spot any 'intruders' in the CH on Thursday :P The OP didn't post up the flight she was on and with 6 flights out to NYC to chose from, it is not possible for any of us to help out without that info.
